Abstract: | The article discusses the main problems and peculiarities of legal regulation of economic activity in Ukraine during martial law in general, as well as business processes in particular. The authors analyze the legal aspects of the functioning of enterprises, the specifics of state control, as well as the interaction of state authorities and business in conditions of increased threat and emergency situations. The study focuses on the main changes that occurred in the legislation during the hostilities, in particular in terms of regulating the circulation of goods, labor relations, resource mobilization and restrictions for business entities. One of the key issues is the impact of martial law on the fulfillment of contractual obligations and liability for their violation. Attention is focused on determining the circumstances that cancel liability for improper performance or non-performance of obligations. It is emphasized that martial law creates conditions when the fulfillment of certain obligations may be difficult or impossible. In addition, the legal challenges associated with export and import restrictions that complicate cooperation with foreign partners are considered. The author provides recommendations for optimizing legal regulation under martial law in order to maintain stable functioning of the economy, protect the rights of business entities, and increase the efficiency of state control over the activities of enterprises. |
