Protection of copyright and related rights in Ukraine: effectiveness of legal instruments

Abstract

The thesis provides the effectiveness of legal instruments for the protection of copyright and related rights in Ukraine under contemporary legal and digital challenges. It outlines the evolution of national copyright legislation, including the transition from the 1993 Law of Ukraine “On Copyright and Related Rights” to the updated legal framework introduced by Law No. 2811-IX. The study identifies key problems that limit the practical effectiveness of copyright protection, including widespread digital piracy, insufficient transparency in collective rights management, procedural difficulties in judicial protection, and challenges related to proving infringements in the digital environment. Special attention is paid to the harmonisation of Ukrainian legislation with international and European standards. The authors emphasise the need to improve enforcement mechanisms, develop digital rights protection tools, strengthen cooperation with online platforms, and enhance judicial and institutional practices.
